In the event that you are detained or killed the video is safe&#8221;<\/span><\/p><\/blockquote>\n<p>I am a little put off by the words &#8220;secretly&#8221; and &#8220;killed.&#8221;\u00a0 This is more sinister than HU4J&#8217;s regular website, which gives helpful tips to app users such as:<\/p>\n<div id=\"yui_3_17_2_1_1424303821999_1726\" class=\"row sqs-row\">\n<div id=\"yui_3_17_2_1_1424303821999_1758\" class=\"col sqs-col-5 span-5\">\n<div id=\"block-yui_3_17_2_63_1420824826550_14702\" class=\"sqs-block html-block sqs-block-html\" data-block-type=\"2\">\n<blockquote>\n<div id=\"yui_3_17_2_1_1424303821999_1761\" class=\"sqs-block-content\">\n<ul id=\"yui_3_17_2_1_1424303821999_1760\" dir=\"ltr\">\n<li>Make sure you have updated driver&#8217;s license, registration, and insurance information.<\/li>\n<li>Be polite and don&#8217;t make any sudden movements.<\/li>\n<li>Always comply with the police officers&#8217; requests.<\/li>\n<li>Tell the officer if there are weapons in the car.<\/li>\n<li>Tell the officer this entire stop is being recorded.<\/li>\n<li>Ask the officer his name, badge number, and reason for the stop.<\/li>\n<li>Don&#8217;t be a jerk to the officer.<\/li>\n<\/ul>\n<\/div>\n<\/blockquote>\n<div id=\"yui_3_17_2_1_1424303821999_1761\" class=\"sqs-block-content\">\n<p>I can support these recommendations.\u00a0 The website also shows a traffic stop which is obviously done by a Florida Highway Patrol trooper.\u00a0 Strangely,\u00a0 I did not find any legal disclaimers on the site.\u00a0 But, there is case law pertaining to officers&#8217; behavior with respect to a citizen recording their conversation.\u00a0 <!--more--><\/p>\n<p>Some officers have made arrests of citizens under FSS 934.03 (1), Interception and Disclosure of Wire, Oral, and Electronic Communications, for the persons recording the officer without the officer&#8217;s consent.\u00a0 This could potentially result in the officer being held civilly liable.\u00a0 Officers do not have a reasonable expectation of privacy during conversations conducted in public in the normal course of their duties.<\/p>\n<p>From a Florida Eighth Circuit State Attorney&#8217;s Office brief:\u00a0 &#8220;In <em>Glik v. Cunniffe<\/em>, et al., the United States Court of Appeals for the First Circuit held that officers were not entitled to qualified immunity when they arrested a bystander for filming them in a public space, ruling that this was exercising a clearly-established First Amendment right.\u00a0 While no Florida court has ruled similarly, that threat still exists that an officer arresting someone for recording them could be personally sued.&#8221;<\/p>\n<p>The situation is different if a citizen is obviously behaving in an obstructive manner while video recording the police.\u00a0 A bystander that approaches officers and inserts himself into a situation by distracting, confronting, or otherwise delaying an officer in the lawful execution of his or her duty commits an arrestable obstruction of justice in FSS 843.02.<\/p>\n<p>Officers should be aware of their department&#8217;s policies in how to handle a citizen pursuing his or her First Amendment rights in the manner posed by the Hands Up 4 Justice app.\u00a0 The best rule of thumb is to act professionally and fairly in all your dealings with the general public.<\/p>\n<p>Randall<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Hands Up 4 Justice is an app that lets people record police\/citizen encounters without the officer knowing that the user&#8217;s cell phone camera is active.\u00a0 Although the message is that taping the interaction is innocent, the Hands Up 4 Justice Facebook page contains the following: &#8220;The App will allow you to secretly record any traffic stop &amp; share &amp; save the video online.
