{"id":8841,"date":"2015-01-01T21:00:30","date_gmt":"2015-01-02T02:00:30","guid":{"rendered":"http:\/\/thinblueflorida.com\/?p=8841"},"modified":"2015-01-01T18:18:21","modified_gmt":"2015-01-01T23:18:21","slug":"new-florida-child-restraint-changes-in-effect-today","status":"publish","type":"post","link":"https:\/\/thinblueflorida.com\/?p=8841","title":{"rendered":"New Florida Child Restraint Changes in Effect Today"},"content":{"rendered":"<div id=\"attachment_8853\" style=\"width: 266px\" class=\"wp-caption alignright\"><a href=\"http:\/\/thinblueflorida.com\/wp-content\/uploads\/2015\/01\/Graco-TurboBooster-Seat.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-8853\" class=\"wp-image-8853\" src=\"http:\/\/thinblueflorida.com\/wp-content\/uploads\/2015\/01\/Graco-TurboBooster-Seat-300x300.jpg\" alt=\"Graco TurboBooster Seat\" width=\"256\" height=\"256\" srcset=\"https:\/\/thinblueflorida.com\/wp-content\/uploads\/2015\/01\/Graco-TurboBooster-Seat-300x300.jpg 300w, https:\/\/thinblueflorida.com\/wp-content\/uploads\/2015\/01\/Graco-TurboBooster-Seat-150x150.jpg 150w, https:\/\/thinblueflorida.com\/wp-content\/uploads\/2015\/01\/Graco-TurboBooster-Seat-1024x1024.jpg 1024w, https:\/\/thinblueflorida.com\/wp-content\/uploads\/2015\/01\/Graco-TurboBooster-Seat.jpg 1500w\" sizes=\"auto, (max-width: 256px) 100vw, 256px\" \/><\/a><p id=\"caption-attachment-8853\" class=\"wp-caption-text\">Graco TurboBooster Convertible Seat<\/p><\/div>\n<p>Changes to Florida&#8217;s Child Restraint requirements go into effect today.\u00a0 Children under five years of age must now be transported in a federally approved separate carrier child seat, vehicle manufacturer&#8217;s integrated child seat, or belt-positioning booster seats while riding in a motor vehicle upon the roadways, streets, or highways of the State.\u00a0 Previously four and five year olds could be restrained with just a seat belt.<\/p>\n<p>Section One of Florida State Statute 316.613 now reads:<\/p>\n<div class=\"Paragraph\">\n<blockquote><p><span class=\"Number\">(1)(a)\u2003<\/span><span class=\"Text Intro Justify\">Every operator of a motor vehicle as defined in this section, while transporting a child in a motor vehicle operated on the roadways, streets, or highways of this state, shall, if the child is 5 years of age or younger, provide for protection of the child by properly using a crash-tested, federally approved child restraint device.<\/span><\/p>\n<div class=\"SubParagraph\"><span class=\"Number\">1.\u2003<\/span><span class=\"Text Intro Justify\">For children aged through 3 years, such restraint device must be a separate carrier or a vehicle manufacturer\u2019s integrated child seat.<\/span><\/div>\n<\/blockquote>\n<div class=\"SubParagraph\">\n<blockquote><p><span class=\"Number\">2.\u2003<\/span><span class=\"Text Intro Justify\">For children aged 4 through 5 years, a separate carrier, an integrated child seat, or a child booster seat may be used. However, the requirement to use a child restraint device under this subparagraph does not apply when a safety belt is used as required in s. <a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0300-0399\/0316\/Sections\/0316.614.html\">316.614<\/a>(4)(a) and the child:<\/span><\/p>\n<p><span class=\"Number\">a.\u2003<\/span><span class=\"Text Intro Justify\">Is being transported gratuitously by an operator who is not a member of the child\u2019s immediate family;<\/span><\/p>\n<div class=\"SubSubParagraph\"><span class=\"Number\">b.\u2003<\/span><span class=\"Text Intro Justify\">Is being transported in a medical emergency situation involving the child; or<\/span><\/div>\n<div class=\"SubSubParagraph\"><\/div>\n<div class=\"SubSubParagraph\"><span class=\"Number\">c.\u2003<\/span><span class=\"Text Intro Justify\">Has a medical condition that necessitates an exception as evidenced by appropriate documentation from a health care professional.<\/span><\/div>\n<\/blockquote>\n<\/div>\n<\/div>\n<p>&nbsp;<\/p>\n<p>Violations of this section are still moving violations with an assessment of three points to the violator&#8217;s driver license.\u00a0 Points can be waived by attending a court-approved child restraint safety course.\u00a0 <a title=\"Florida Child Restraint Statute\" href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0300-0399\/0316\/Sections\/0316.613.html\" target=\"_blank\">Link to the entire statute here.<\/a><\/p>\n<p>Randall<\/p>\n<div class=\"Subsection\"><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Changes to Florida&#8217;s Child Restraint requirements go into effect today.\u00a0 Children under five years of age must now be transported in a federally approved separate carrier child seat, vehicle manufacturer&#8217;s integrated child seat, or belt-positioning booster seats while riding in a motor vehicle upon the roadways, streets, or highways of the State.\u00a0 Previously four and five year olds could be restrained with just a seat belt.
