{"id":2788,"date":"2012-09-25T23:00:41","date_gmt":"2012-09-26T03:00:41","guid":{"rendered":"http:\/\/thinblueflorida.com\/?p=2788"},"modified":"2012-09-25T20:11:29","modified_gmt":"2012-09-26T00:11:29","slug":"changes-proposed-for-floridas-photo-array-and-live-lineup-procedures","status":"publish","type":"post","link":"https:\/\/thinblueflorida.com\/?p=2788","title":{"rendered":"Changes Proposed for Florida&#8217;s Photo Array and Live Lineup Procedures"},"content":{"rendered":"<p><a href=\"http:\/\/thinblueflorida.com\/wp-content\/uploads\/2012\/09\/IMG_18851.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-large wp-image-2792\" title=\"IMG_1885\" src=\"http:\/\/thinblueflorida.com\/wp-content\/uploads\/2012\/09\/IMG_18851-1024x768.jpg\" alt=\"\" width=\"640\" height=\"480\" srcset=\"https:\/\/thinblueflorida.com\/wp-content\/uploads\/2012\/09\/IMG_18851-1024x768.jpg 1024w, https:\/\/thinblueflorida.com\/wp-content\/uploads\/2012\/09\/IMG_18851-300x225.jpg 300w, https:\/\/thinblueflorida.com\/wp-content\/uploads\/2012\/09\/IMG_18851.jpg 1300w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a>The Florida Department of Law Enforcement, Florida Police Chief&#8217;s Association, Florida Sheriff&#8217;s Association, and the Florida Prosecuting Attorneys Association are issuing standardized guidelines for law enforcement agencies shaping how photographic and live lineups will be conducted in the future.<\/p>\n<p>Originally proposed by the Florida Innocence Commission and used in the Eyewitness Reform Act (<a title=\"SB 1206\" href=\"http:\/\/www.flsenate.gov\/Session\/Bill\/2011\/1206\" target=\"_blank\">SB 1206<\/a> and <a title=\"HB 821\" href=\"http:\/\/www.flsenate.gov\/Session\/Bill\/2011\/821\" target=\"_blank\">HB 821<\/a>), this legislation failed in both houses last year.\u00a0 Though lobbying in Tallahassee against legislative mandates, the FDLE, FPCA, FSA, and FPAA have endorsed voluntary changes to photo and live lineup procedures.<\/p>\n<p>Because the FPAA is &#8220;requiring&#8221; the voluntary changes in each judicial circuit, the implementation of these guidelines is a foregone conclusion.\u00a0 Your police agency will be adopting them.<\/p>\n<p>The <a title=\"Standards for Florida State and Local Law Enforcement...\" href=\"http:\/\/www.google.com\/url?sa=t&amp;rct=j&amp;q=%E2%80%9Cstandards%20for%20florida%20state%20and%20local%20law%20enforcement%20agencies%20in%20%20dealing%20with%20photographic%20or%20live%20lineups%20in%20eyewitness%20identification%E2%80%9D%20%20&amp;source=web&amp;cd=2&amp;cad=rja&amp;ved=0CCcQFjAB&amp;url=http%3A%2F%2Fwww.flcourts.org%2Fgen_public%2Fbin%2FappendixG1.rtf&amp;ei=wrthUPCyApTg8wSL-IDoAw&amp;usg=AFQjCNGqHpoA3bSmpi6sRigqVE_gdWcnUQ\" target=\"_blank\"><em>Standards for Florida State and Local Law  Enforcement Agencies in Dealing with Photographic or Live Lineups in  Eyewitness Identification<\/em><\/a> outlines the Florida Innocence Commission&#8217;s position on the matter.\u00a0 Subsequent to this, the FDLE, FPCA, FSA, and FPAA issued their <a title=\"Commentary and Instructions PDF\" href=\"http:\/\/www.google.com\/url?sa=t&amp;rct=j&amp;q=Florida+Prosecuting+Attorneys+Association+photo+lineup&amp;source=web&amp;cd=3&amp;cad=rja&amp;ved=0CCsQFjAC&amp;url=http%3A%2F%2Fwww.fdle.state.fl.us%2FContent%2Fgetdoc%2F3f78dca0-99b3-485c-8b34-42de7594e315%2FEyewitnessGuidelinesCommentary.aspx&amp;ei=X8VhUPzNII7S9ASvtoC4Cg&amp;usg=AFQjCNFPlzqSkUZ5QPN-Il8MB5o-xFo4CQ\" target=\"_blank\">Commentary and Instructions<\/a> to the above standards.<em> <\/em><\/p>\n<p>The general standards can be summed up here:<\/p>\n<blockquote><p>III. Standards for Florida State and Local Law Enforcement Agencies in Dealing with Photographic or Live Lineups in Eyewitness Identification<\/p>\n<p>Each Florida state and local law enforcement agency shall have in place a written policy regarding photographic or live lineups to be utilized in eyewitness identification.\u00a0 The policy shall address at a minimum the following:<\/p>\n<p>A.\u00a0\u00a0\u00a0 The creation, composition, and utilization of the photo array or lineup.<br \/>\nB.\u00a0\u00a0\u00a0 Standard instructions to be used to instruct the witness <!--more-->prior to a photographic or live lineup.<br \/>\nC.\u00a0\u00a0\u00a0 Direction to the investigator conducting the photographic or live lineup to avoid any conduct that might directly or indirectly influence the witness\u2019s decision; and to avoid comments or actions that suggest the witness did or did not identify the suspect.<br \/>\nD.\u00a0\u00a0\u00a0 How to discern the level of confidence in an identification as expressed by the witness.<br \/>\nE.\u00a0\u00a0\u00a0 How to document the procedure and outcome of the photographic or live lineup, including noting the witness\u2019s response and exact words.<br \/>\nF.\u00a0\u00a0\u00a0 The method(s) of presenting the lineup.<br \/>\nG.\u00a0\u00a0\u00a0 Requiring training on the agency policy by any agency personnel who will be administering a photographic or live lineup.<\/p><\/blockquote>\n<p>In the Commentary and Instructions, FPAA addresses simultaneous and sequential photo arrays and live lineups.\u00a0 Also of importance is the inclusion of a double-blind component to lineups.\u00a0 Under the standards, the use of an Independent Administrator, who has no knowledge of the suspect&#8217;s identity, is urged.<\/p>\n<p>In recent years, DNA test results have brought to light the fallibility of eyewitness identification in criminal cases.\u00a0 The Florida Innocence Commission&#8217;s research into mistaken identification led to the rush to alter how law enforcement agencies assist witnesses in viewing potential suspects.<\/p>\n<p>Although my department&#8217;s General Orders and Photo Array Instructions already comply with the new standards, we will probably begin using sequential photo arrays shown by a &#8220;blind&#8221; administrator instead of the simultaneous array predominantly shown by by the lead investigator or his partner.<\/p>\n<p>The most current information I found on the subject was in <a title=\"NIJ:  To Err is Human\" href=\"http:\/\/www.nij.gov\/journals\/270\/reduce-eyewitness-mistakes.htm\" target=\"_blank\">a National Institute of Justice article from June 15, 2012<\/a>.\u00a0 I think this statement from that article sums up eyewitness identification:\u00a0 &#8220;The police lineup is an inherently human process, and therefore inherently flawed.&#8221;\u00a0 Eyewitness identification, whether through photographs or live viewing, should only be a part of the measure of probable cause in a criminal case.\u00a0 To err is human&#8230;<\/p>\n<p>Randall<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Florida Department of Law Enforcement, Florida Police Chief&#8217;s Association, Florida Sheriff&#8217;s Association, and the Florida Prosecuting Attorneys Association are issuing standardized guidelines for law enforcement agencies shaping how photographic and live lineups will be conducted in the future.
